Terms of Service

1. Introduction

Welcome to Capusc. These Terms of Service ("Terms") govern your use of the Capusc website located at capusc.com and any related services operated by Capusc ("we," "us," or "our"). By accessing or using the Service you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you do not agree, please do not use the Service.

2. Service Description

Capusc is a multi-modal transport booking aggregator that enables users to search, compare, and book air, sea, rail, and bus tickets offered by third-party transport providers ("Providers"). We act as an intermediary technology platform. We do not operate any vehicles or vessels ourselves, and we are not a party to the contract of carriage between you and the Provider.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.

3. User Accounts

To access certain features you may be required to create an account. You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the security of your password and restrict access to your account.
  • Notify us immediately at [email protected] if you suspect any unauthorised use of your account.
  • Accept responsibility for all activities that occur under your account credentials.

We may suspend or terminate your account if you breach these Terms or if we reasonably believe your account is being used fraudulently or unlawfully.

4. Bookings and Payments

When you complete a booking through the Service, you enter into a direct contract of carriage with the relevant Provider. Capusc facilitates that transaction but is not the contracting carrier.

  • Pricing. Fares and fees are set by Providers and are displayed inclusive of all taxes and mandatory charges where required by applicable law. Prices are subject to availability and may change at any time before payment is confirmed.
  • Payment processing. Payments are processed by PCI-DSS-compliant third-party payment processors. By providing your payment details you authorise us to initiate the transaction on your behalf. We do not store your full card number.
  • Booking confirmation. A booking is confirmed only when you receive a written confirmation from us via email. We reserve the right to cancel a booking that has been confirmed in error, subject to a full refund.
  • Service fees. Capusc may charge a service or booking fee in addition to the Provider fare. Any such fee will be clearly disclosed before you confirm payment.

5. Cancellations and Refunds

Cancellation and refund policies are determined by each Provider's fare rules and may vary significantly. Before completing a booking, please review the applicable fare conditions, including whether the ticket is refundable, exchangeable, or non-refundable.

Where a Provider authorises a refund, we will process it to your original payment method within the timeframe mandated by the Provider (typically 5–14 business days). Capusc service fees are generally non-refundable unless the cancellation results from our error or a Provider's cancellation of service.

EU residents retain all statutory rights under Regulation (EC) No 261/2004 (air travel) and comparable regulations for other transport modes, which Providers must honour independently of these Terms.

6. User Obligations

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulation.
  • Scrape, crawl, or extract data from the Service using automated means without our prior written consent.
  • Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure.
  • Submit false, misleading, or fraudulent information in connection with any booking.
  • Resell or commercially exploit tickets obtained through the Service without our written authorisation.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Capusc and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.

Our aggregate liability to you for any direct damages shall not exceed the total amount paid by you to Capusc in the twelve (12) months preceding the claim. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of information provided by Providers through the Service.

8. Intellectual Property

All content, trademarks, service marks, logos, and other intellectual property displayed on or through the Service are owned by or licensed to Capusc. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

You retain ownership of any content you submit to us (such as reviews or feedback). By submitting such content you grant Capusc a worldwide, royalty-free, non-exclusive licence to use, display, and distribute it in connection with operating the Service.

9. Dispute Resolution

In the event of a dispute, we encourage you to contact us first at [email protected] so that we may attempt to resolve the matter informally. We will endeavour to respond within 30 days.

If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of a mutually agreed arbitral institution, on an individual basis. You waive any right to participate in a class action or class-wide arbitration. Nothing in this clause prevents either party from seeking injunctive relief in a court of competent jurisdiction.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Capusc is incorporated, without regard to its conflict-of-law provisions. EU consumers may also rely on the mandatory consumer protection laws of their country of habitual residence.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. For material changes we will make reasonable efforts to notify registered users (e.g., via email or an in-app notice). Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
